Welcome to the Nueva Global, LLC (“Nueva,” “we,” “us,” or “our”) website. These Terms of Use (“Terms”) govern your access to and use of our website (“Site”) and any products purchased through it. By accessing or using our Site, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must not use the Site or purchase products from us.
Nueva Global, LLC is an online retail platform that offers dietary supplements and nutraceuticals in oral dosage form. Our products are marketed and sold in compliance with the Dietary Supplement Health and Education Act of 1994 (DSHEA), the Federal Food, Drug, and Cosmetic Act (FD&C Act), the labeling requirements in 21 CFR Part 101, the current good manufacturing practice (cGMP) requirements for dietary supplements in 21 CFR Part 111, and the advertising standards of the Federal Trade Commission Act (§ 5).
All products are intended solely for lawful dietary supplement use and not for any prohibited or off-label purpose. Products are not intended to diagnose, treat, cure, or prevent any disease. Structure/function claims are made only when substantiated and are accompanied by the required DSHEA disclaimer:
“This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.”You must be at least 18 years old to purchase products from Nueva. By placing an order, you represent that you meet this requirement, that the information you provide is accurate and complete, and that you are purchasing for personal use or lawful resale in compliance with applicable laws.
Nueva reserves the right to refuse service, cancel orders, or terminate accounts if misuse, fraud, or other noncompliance with these Terms is suspected.
In consideration for your compliance with these Terms, Nueva provides you with the ability to purchase products through our Site. By placing an order, you acknowledge that you have the capacity to be bound by this Agreement or that you have the authority to bind the entity on whose behalf you are acting.
Nueva ships products only to addresses within the United States. We do not accept international orders. You confirm by placing an order that the shipping address is a valid U.S. address.
Payments may be processed by a third-party payment processor. By placing an order, you authorize Nueva to share necessary payment information with our designated processor(s) to complete the transaction. You agree to review and comply with any applicable terms of the payment processor. Orders are not final until payment has been successfully processed and verified.
Nueva reserves the right to verify your identity, payment credentials, and order details prior to shipment. We may delay or cancel a transaction if there is reason to suspect fraud or noncompliance with these Terms.
Products are shipped from 11301 Metro Airport Center Dr, Ste 105 Romulus MI 48174 and generally take 5-7 business days to receive your order. Once a package is accepted by the carrier, risk of loss transfers to you. Nueva is not responsible for delivery delays or damage caused by the carrier but will assist in resolving such issues when possible. Customers are responsible for all return shipping costs. Shipping fees (if applicable) are non-refundable.
It is your responsibility to provide accurate and complete shipping information at checkout. Nueva is not liable for packages lost or misdelivered due to incorrect information provided by the purchaser.
At Nueva, your satisfaction is our priority. That’s why we offer a 30-Day Empty Bottle Guarantee on all of our products. Refunds will be issued to the original form of payment. If your product arrives damaged or incorrect, please contact us within 7 days of delivery. We’ll replace the item or issue a full refund at no cost to you. Returns received after the 30-day window will not be processed. Refunds will be issued to the original payment method after inspection of the returned product. Shipping fees are non-refundable.
All content on the Site, including text, images, product data, logos, graphics, and software, is the property of Nueva or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from this content without prior written consent from Nueva.
Nueva’s Privacy Policy describes the categories of personal information we collect, the purposes for which it is used, and how it may be shared with third parties. The Privacy Policy limits data use to legitimate purposes such as order fulfillment, fraud prevention, and customer service, and describes safeguards, retention periods, and customer rights. Our Privacy Policy is incorporated into these Terms by reference.
The Site and all products are provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, Nueva disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nueva shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use or misuse of our products or Site. Our total liability shall not exceed the purchase price of the product giving rise to the claim.
You agree to indemnify, defend, and hold harmless Nueva, its officers, directors, employees, affiliates, and contractors from and against all claims, damages, liabilities, losses, or expenses (including attorneys’ fees) arising from your violation of these Terms, your misuse of products, or your infringement of any intellectual property or other rights.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site will be resolved exclusively through binding arbitration in accordance with Delaware law. You waive the right to participate in class-action lawsuits or class-wide arbitration. If arbitration is not applicable, disputes shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you agree to submit to the jurisdiction of those courts.
Nueva may update or revise these Terms at any time. The most current version will be posted on our website with the “Effective Date” updated accordingly. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
